NOTICE OF PUBLIC HEARING ON PROPOSED PROJECT

AND FINANCIAL ASSISTANCE RELATING THERETO

 

Notice is hereby given that a public hearing pursuant to Section 859-a(2) of the General Municipal Law of the State ofNew York will be held by Columbia County Industrial Development Agency (the “Agency”) on the 15th day of April, 2019, at 8:30 o’clock a.m., local time, at the A.B. Shaw Firehouse located at 67 State Route 23, in the Town of Claverack, Columbia County, New York, in connection with the following matters:

Drumlin Field Ventures, LLC and Drumlin Field Land, LLC (the “Applicants”) have requested that the Agency consider undertaking a project (the “Project”) consisting of a craft farm distillery focused on the production, aging, marketing and sale of ultra-premium apple and grape brandy produced in New York’s Hudson Valley from New York State fruit at premises located at 2320 County Route 27 in the Town of Claverack consisting of approximately 182 acres of land of which approximately 70 to 100 acres will be planted with fruit orchards and vineyards on land which was formally orchards and which project will also include construction of an approximately 20,800 square foot complex of three buildings which will house the distillery, tasting room, offices, winery/cidery and warehouse; and

Whereas, the Applicants have filed an Application with the Columbia County Industrial Development Agency requesting financial assistance from the Agency with respect to this project in accordance with the provisions of Article 18-A of the General Municipal Law of the State of New York which financial assistance would include the potential exemption from sales and use taxes, in connection with the construction of the project and the acquisition of equipment, exception from mortgage recording taxes and a Payment In Lieu Of Tax Agreement (PILOT) with respect to real estate taxes, and

Whereas, the Agency is considering whether to undertake the Project and to finance the Project in accordance with the authority granted to the Agency under General Municipal Law Article 18-A, and

Whereas, THE OBLIGATIONS REFERENCED HEREIN SHALL NOT BE A DEBT OF THE STATE OF NEW YORK OR THE COUNTY OF COLUMBIA, NEW YORK, AND NEITHER THE STATE OF NEW YORK OR THE COUNTY OF COLUMBIA, NEW YORK SHALL BE LIABLE THEREON.

The Agency has not yet made a determination pursuant to Article 8 of the Environmental Conservation Law (the “SEQR Act”) regarding the potential environmental impact of the Project.

The Agency will at said time and place hear all persons with views on the location and/or nature of the proposed Project and the Financial Assistance being contemplated by the Agency in connection with the proposed Project. A copy of the Application filed by the Applicants with the Agency with respect to the Project is available for public inspection during normal business hours at the office of the Agency located at 4303 Route 9, Hudson, New York 12534; Telephone (518) 828- 4718.

The proposed PILOT Agreement is in accordance with the Agency’s standard industrial PILOT Agreement Policy and the proposed terms thereof are available for public inspection during normal business hours at the office of the Agency.
